These Terms & Conditions govern bookings, photography services, purchases, digital products, and use of services provided by The Portrait Room Studios.
By booking a session, completing a purchase, or using our services, you agree to the terms applicable to that transaction, including any session-specific terms presented during booking.
BOOKINGS
Appointments are subject to availability and are not guaranteed until the booking process and any required payment or payment authorization have been completed.
Clients are responsible for providing accurate contact and booking information.
SESSION FEES
Session fees compensate The Portrait Room Studios for reserving studio time and providing photography services.
Unless a package specifically states otherwise, payment of a session fee does not automatically include photographs, prints, digital images, or products.
$0 SESSION-FEE OFFERS
For appointments advertised with a $0 session fee, there is no charge for the photography session itself unless the client violates applicable cancellation or no-show terms.
Digital photographs, prints, products, and collections are sold separately unless expressly included in the promotion.
Prices for optional image and product purchases will be disclosed through the applicable sales gallery, price list, or offer.
PAYMENTS
Prices and applicable fees are presented at booking or purchase.
Clients authorize charges that they expressly approve as part of a booking or purchase, as well as charges specifically authorized under an agreed cancellation/no-show policy.
Applicable taxes may be added where required.
CANCELLATIONS, RESCHEDULING & NO-SHOWS
Cancellation, rescheduling, and no-show requirements may vary depending on the session or promotion.
The applicable terms presented during booking form part of these Terms & Conditions.
Promotional or $0 session-fee appointments may be subject to a $50 no-show or late-cancellation fee when disclosed and agreed to during booking.
LATE ARRIVALS
Clients are asked to arrive 15 minutes before their scheduled appointment.
Late arrival does not extend the scheduled session. Photography time may be shortened, and appointments may need to be rescheduled if insufficient time remains to reasonably complete the session.
PURCHASES
Clients are responsible for reviewing image selections, quantities, sizes, cropping, and other product choices before completing a purchase.
Because photography products are personalized, certain purchases may be final once production, editing, downloading, or fulfillment has begun, except where otherwise required by law or where a product is defective.
DIGITAL PRODUCTS
Due to the nature of digital products, purchases of digital photographs generally become final once the digital file has been delivered or made available for download, except as required by law.
Clients should download and create backups of purchased files promptly.
PRINTS & PHYSICAL PRODUCTS
Clients should inspect physical products promptly after delivery.
If an item arrives damaged, defective, or materially different from the order, please contact us promptly so we can evaluate the issue and, where appropriate, arrange a replacement or other remedy.
COPYRIGHT
Unless expressly transferred in a signed written agreement, all photographs created by The Portrait Room Studios remain protected by copyright owned by the photographer or applicable copyright holder.
Purchasing photographs does not transfer copyright ownership.
PERSONAL-USE LICENSE
Purchased digital photographs are generally licensed for the client's personal, noncommercial use.
Clients may display purchased images personally and may make personal prints where permitted.
Images may not be sold, commercially licensed, entered into commercial advertising, materially altered and represented as the photographer's finished work, or otherwise commercially exploited without written authorization.
PROOFS & WATERMARKED IMAGES
Unpurchased proofs and watermarked images may not be downloaded, screenshot, copied, reproduced, published, edited to remove a watermark, or otherwise used without authorization.
Access to an online gallery does not constitute a license to use unpaid images.
CREATIVE STYLE
Photography is a creative service.
By booking The Portrait Room Studios, clients acknowledge that they have reviewed or had the opportunity to review our photographic style and understand that factors including lighting, posing, expressions, composition, backgrounds, editing, and final image selection involve professional and artistic judgment.
We do not guarantee reproduction of a specific photograph, pose, expression, or image created by another photographer.
IMAGE SELECTION
The Portrait Room Studios retains professional discretion regarding which photographs are presented as proofs or finished images.
Images that are duplicates, test shots, technically unsuitable, or otherwise inconsistent with our professional standards may not be delivered.
RAW or unedited files are not included unless expressly agreed to in writing.
CLIENT COOPERATION
Successful photography depends on reasonable cooperation from the client and participants.
While we will make reasonable efforts to create quality photographs, we cannot guarantee particular expressions, poses, participation from children or pets, or a specific number of usable photographs when circumstances are outside the photographer's reasonable control.
FORCE MAJEURE & UNFORESEEN CIRCUMSTANCES
If services cannot reasonably be provided because of illness, emergency, severe weather, equipment failure, power outage, government restriction, unsafe conditions, or another circumstance beyond reasonable control, The Portrait Room Studios may reschedule the session or provide another appropriate remedy.
TECHNICAL FAILURE
We use reasonable professional care when photographing, storing, and processing images.
In the unlikely event photographs are lost, corrupted, destroyed, or otherwise unavailable because of equipment or storage failure, any remedy will be determined in accordance with applicable law and the circumstances of the transaction.
Nothing in these Terms excludes liability that cannot legally be limited or excluded.
PROMOTIONS
Promotional offers may contain additional terms and restrictions.
Unless otherwise stated, promotions have no cash value, may not be combined with other offers, and may not be applied retroactively.
PRICING & AVAILABILITY
Current prices, products, packages, promotions, and availability may change from time to time.
Changes do not retroactively alter completed purchases or confirmed bookings governed by previously agreed pricing and terms.
WEBSITE CONTENT
Website photographs, branding, graphics, written content, logos, and other materials belonging to The Portrait Room Studios may not be copied or commercially used without permission except as allowed by law.
LIMITATION OF TERMS
Nothing contained in these Terms & Conditions is intended to waive or restrict a consumer right or remedy that cannot legally be waived under applicable law.
If one provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
CHANGES TO THESE TERMS
These Terms may be updated periodically. The version applicable to a particular completed booking or purchase will generally be the terms accepted in connection with that transaction.
